
The Tamil Nadu government has superseded the Tamil Nadu Real Estate Regulatory Authority (TNRERA) following the resignation of its chairperson and all serving members, paving the way for an interim administration to oversee the state’s real estate regulatory framework.
Through a Government Order issued by the Housing and Urban Development Department on July 14, the state appointed former IAS officer K Phanindra Reddy as the interim chairperson of TNRERA. Retired District Judge A. Nazir Ahamed and retired IAS officer Reeta Harish Thakkar have been appointed as members of the authority.
The interim team will discharge the statutory functions of TNRERA for a period of six months or until the authority is reconstituted, whichever is earlier.
The move follows the resignation of TNRERA Chairperson Shiv Das Meena and members L. Subramanian, M. Krishnamoorthy, D. Jagannathan and Sukumar Chittibabu. The government accepted their resignations and stated that the authority was no longer in a position to perform its statutory responsibilities.
The decision has been taken under Section 82 of the Real Estate (Regulation and Development) Act, 2016, which empowers the state government to supersede a Real Estate Regulatory Authority if it is unable to discharge its functions effectively.
TNRERA plays a crucial role in regulating Tamil Nadu’s real estate sector by overseeing project registrations, protecting homebuyers’ interests, ensuring compliance by developers and adjudicating disputes between promoters and property buyers.
The government has clarified that the interim appointments are intended to ensure uninterrupted functioning of the regulatory authority while the process of constituting a new permanent panel is initiated.
Under the provisions of the Real Estate (Regulation and Development) Act, vacancies in the authority must be referred to a selection committee comprising the Chief Justice of the Madras High Court and senior officials from the Housing and Law departments. The committee will constitute a search panel to identify eligible candidates before recommending names to the state government for final appointments.
The temporary arrangement is expected to maintain regulatory continuity in Tamil Nadu’s real estate sector, ensuring that project approvals, dispute resolution and regulatory oversight continue without disruption during the transition period.
