Brigade Group Challenges Environmental Clearance Revocation for Chennai Housing Project

Brigade Group has challenged the revocation of environmental clearance (EC) granted for its Brigade Morgan Heights residential project in Perumbakkam, Chennai, and has initiated legal and regulatory proceedings, including filing an appeal against the order.

The real estate developer issued a clarification stating that the project site consists of private patta land classified as dry land in revenue records dating back to 1935. According to the company, the land has remained under continuous ownership of the present landowners since 1985, and a Joint Development Agreement was signed in 2022.

Brigade Group said all statutory approvals for the project were obtained by January 2025. The company also noted that public notices were issued during the approval process and that no objections were received at the time.

The clarification comes after the State Level Environment Impact Assessment Authority (SEIAA) revoked the project’s environmental clearance. Brigade Group described the revocation as arbitrary and maintained that the project site does not fall within any officially notified wetland area under the Wetlands (Conservation and Management) Rules, 2017.

The developer referred to a clarification issued by the Tamil Nadu Environment, Climate Change and Forest Department in October 2025, which stated that the land in question was private patta land and that final wetland boundaries had not yet been determined.

The company also cited a Madras High Court order dated February 10, 2026, in which a Public Interest Litigation related to the project was dismissed. According to Brigade Group, the court observed that pending ground verification under the Ramsar process, the land could not be conclusively designated as a wetland.

Brigade Group further alleged that the environmental clearance was revoked without prior notice, hearing, site verification, or an opportunity for the company to present its position. It stated that the decision could affect ongoing construction activity, investments already made, and third-party interests associated with the development.

The company has indicated that it will continue to pursue legal remedies while seeking clarity on the reasons behind the cancellation order. The issue is being closely watched by the real estate sector, as it could have implications for multiple developments located within the broader Ramsar influence zone in South Chennai.
