
The Tamil Nadu Real Estate Regulatory Authority (TNRERA) has delivered a significant order in favour of homebuyers, holding a developer responsible for delaying the handover of an apartment despite the buyer fulfilling all payment obligations under the agreement.
According to the order, the complainant argued that he had made all payments on time and was in no way responsible for the delay in the completion of the project. The buyer further stated that the cancellation of the original allotment and the subsequent resale of the flat had placed him under severe financial stress, as he was forced to continue paying house rent while also servicing his home loan.
The developer, however, sought to justify the delay by citing multiple external factors, including natural calamities, shortage of labour, unavailability of construction materials and delays in obtaining statutory approvals.
Rejecting these submissions, TNRERA observed that such reasons are generic in nature and cannot be accepted as valid grounds for project delays under the regulatory framework. The authority made it clear that developers are expected to anticipate such challenges while committing delivery timelines to buyers.
In its order, the authority noted that arranging labour, securing construction materials and obtaining all required approvals are the sole responsibility of the developer. It further pointed out that once a project has already been registered with TNRERA, the question of pending statutory approvals does not hold merit.
The authority described the reasons cited by the developer as “lame excuses” and held the respondent fully responsible for the delay in handing over possession of the apartment.
The ruling is being seen as a strong message from the regulator to developers across Tamil Nadu, reinforcing accountability and strengthening homebuyer protection in the real estate sector.
